The mother-of-14 and media personality was due to perform a series of live topless shows at the T's Lounge in West Palm Beach this month, but backed out of the deal after a dispute with the club's owner.
In retaliation the owner then sued Suleman, seeking damages of up to $15,000 (£9,669) for "irreparable harm" and breach of contract.
Suleman is scheduled to make an appearance this Friday (July 13) at a competing strip club in Hollywood, prompting the T's Lounge owner to request an emergency hearing for the case.
However Circuit Judge Timothy McCarthy ruled against holding the emergency hearing, saying that the situation does not "constitute a legal emergency."
Though Suleman's scheduled performance will reportedly go on this Friday, the lawsuit is still ongoing.
