According to Deadline, the Super Size Me filmmaker came up with the concept for the programme.
The project is said to be set in Texas and has been described as a "big-canvas" political drama.
Spurlock approached Brokeback Mountain scribes Larry McMurtry and Diana Ossana about the show and they have written a script. The duo will also executive produce along with Spurlock.
HBO is currently developing a number of new programmes including a project from Aaron Sorkin, a drama starring Claire Danes and a comedy called Veep from Armando Iannucci.
